Who can do surrogacy processes
in Albania?
In this COUNTRY the following persons can carry out surrogacy procedures:
🔹Married heterosexual couples, without the need to prove medical problems.
🔹Unmarried heterosexual couples, without the need to prove medical problems.
🔹Single men.
The law on surrogacy in Albania
Law 8876, dated 4.4.2002 on Reproductive Health, in its article 43 recognizes surrogacy as a valid technique of assisted reproduction, although it does not subsequently develop any regulations.
Therefore, these processes can be done legally in these countries, as it has been done for the last 4 years. Often ALBANIA becomes the best option for economic reasons since the programs in ALBANIA cost less than half the cost of a program in the USA or CANADA, which has made them the preferred programs for many Europeans.
One of the main advantages that this country offers us are its prices, which are much cheaper than in the United States. The geographical proximity to our country also means that many couples opt for this destination when it comes to carrying out a surrogacy process.
As in the majority of countries, the surrogacy that is carried out in ALBANIA is the Gestational or total surrogacy, which is the one in which the surrogate does not provide genetic material, which is prohibited in the majority of countries that carry out surrogacy.
The genetic material is either provide by the intended parents or by a donor. When we resort to a donor, the donor can only be an egg donor, since in this country there is no court ruling, paternity is determine by filiation, and the father must prove his biological relationship with the baby. The donor can be anonymous or chosen.
In whose name will the baby be register after birth?
Once the birth has taken place, the intended parents must register the baby in the civil registry. To do this, a birth certificate issued by the clinic must be provide. In the certificate issued by the civil registry in Tirana, both the commissioning father and the surrogate appear
At the same time, we will obtain a waiver from the surrogate mother, which we may need later in our country of origin if we want the baby to be adopt by our partner or spouse.
Special characteristics of the country:
Albania has come to replace Russia on the world map of surrogacy, (Russia banned surrogacy in this country for foreigners on 14.12.2023). ALBANIA does not require medical certificates about the reasons that prevent a heterosexual couple from gestate, and allows surrogacy for single men or homosexual couples.
