The surrogacy law in Colombia

Colombia is a destination where these gestational journeys are actively practised by local clinics. While there are no explicit surrogacy laws in colombia, the legal system functions effectively for intended parents, as the courts ultimately withdraw all custody from the gestational carrier because she possesses no genetic link with the baby. The absence of an explicit regulatory framework is an important factor to bear in mind when choosing this nation to become a parent, but it presents a workable legal pathway.

In Colombia there is no explicit law on surrogacy. This is something to bear in mind if you finally choose this country to become a parent.

Once the baby is born, a process of impugnation of the maternity of the surrogate takes place, given that it is proven that the baby has a genetic link with the intended parent, and on the contrary has no link with the surrogate. The court definitively disassociates the surrogate from the baby, by means of a judicial sentence.

In the 2022-2023 legislature in Colombia, two bills were introduced that sought to regulate the issue. The proposed bills were P.L. 334-2023C filed by the representative to the chamber Alejandro Ocampo Giraldo and P.L. 345 of 2023C filed by the Minister of Justice and Law, Mr. Néstor Iván Osuna Patiño.

Under the established Colombian constitutional framework, any future surrogacy laws in colombia must be processed as statutory laws, which require a highly specific and rigorous special procedure within the Congress of the Republic.

One of these requirements is that they must be processed and approved within the same legislative year, which in our case was from 20 July 2022 to 16 December 2022 and from 16 March 2023 to 20 June 2023.

As of today, no other bill has been presented that intends to regulate surrogacy in Colombia and according to interviews with the Minister of Justice and Law it will not be presented for the time being due to the complex legislative agenda.

For the above reasons, the information that surrogacy processes will be closed in Colombia as of September 2023 is denied, and we share the links where you can verify that the two bills have been duly filed.

Legal warning: Obviously, we cannot guarantee that there will be new bills in the future, for or against surrogacy, something that can happen in every country. However, no new law can be apply retroactively, so, when there is a change in the law, the ongoing processes are respected, as it happened in the other countries where there was a legislative change against surrogacy: Vietnam, Laos, Cambodia, Mexico, Russia, Nepal or Thailand.

However, if the absence of legislation is a problem for you, you can do the process in the other countries where Gestlife has its own offices, and they have programs for single men and homosexual couples.

Gestlife is the only company in the sector that has contracted civil liability insurance with the prestigious North American insurance company HISCOX, which also has a presence in Europe. This civil liability insurance covers up to US$1 million per client in the event that Gestlife causes unintentional damages due to errors or omissions in specific work (medical, legal) to people who have contracted Gestlife’s services, paying the compensation and legal expenses for which it is responsible.

In January 2026, the company WORLD CENTER OF BABY, which had no physical presence or offices in the countries it served, officially declared bankruptcy, leaving hundreds of parents stranded. Without their children. Without the money they had paid. And WORLD CENTER OF BABY did not have liability insurance to cover those amounts.

If you speak to more agencies, ask them if they have liability insurance, and if they say yes, ask them to tell you which company, show you the policy, and the last paid receipt.

Once the birth has taken place, the intended parents must register the baby in the civil registry of Bogotá, Colombia. To do so, a birth certificate issued by the clinic must be provide.
The impugnation of the maternity will be initiated by the surrogate. In this way you then obtain the Colombian passport, passport of the parents´nationality or safe-conduct (depending on the nationality of the parents). Consult your case with your family advisor at Gestlife.
In the case of unmarried males, the surrogate appears on the birth certificate. It will later be remove when the court accepts the impugnation of the maternity (which is always the case because the surrogates have no genetic link to the child).

Our staff will assist you at our office in Bogotá (Colombia) in your language (Spanish, French, Italian, German, English, Portugal). In a process where legal issues are mixed with medical issues, it is important to speak the same language and to understand each other. With Gestlife, you will never feel like a stranger in a foreign country.

It is something that seems obvious, when with some agencies you are lucky enough to speak to an advisor in your language, but as soon as you sign the contract, the rest of the staff do not speak it, and you will have to defend yourself in English, or in another language, with translators. Make sure if you talk to other agencies that this will not happen. A year and a half (the length of a process) having to speak in other languages is very stressful.

Gestlife has its own office in this country. We are not intermediaries. Our staff will attend you in our office in Bogotá, Colombia, in your language. In a process in which legal matters are mixed with medical matters, it is important to speak the same language and understand each other. With Gestlife, you will never feel like a stranger in a foreign country.

Gestlife has lawyers in its office in Bogota, Colombia, to assist you throughout the process.

Most “agencies” finish their work when they hand over the baby to you. Others help you to leave the country, but then it is up to you to register your baby in your country of origin. At Gestlife we have a network of lawyers in all countries, to take care of the final procedure in your country of origin that will allow you to register your child without any problems.

We try our best to make the surrogacy process a pleasure trip, not a nightmare. But there can always be setbacks, which can endanger the intended parents (illness, accident).

Gestlife takes care of managing your travel assistance insurance, to guarantee you complete assistance in the event of any incident, and we take care of managing and organizing all the services related to this issue, so that you don’t have to worry about it.

Our philosophy is to take care of the parents 24 hours a day.

A surrogacy process in Colombia costs between 68.000 and 86.000 euros depending on the program and insurances chosen.

In all our countries, you can take out the following programs:

  • BASIC
  • STANDARD
  • STANDARD PLUS
  • STANDARD PLUS PREMIUM

You can consult the services included in each program in the dossiers of each country. Ask your family advisor for them, without obligation.

Gestlife is one of the few agencies that have programs for parents who test positive for HIV, Hepatitis or sexually transmitted diseases. Nowadays, this is not an impediment to parenthood. If this is your case, consult with your family counsellor, and we will be happy to help you.

As in most regulated destinations, the gestational process carried out in Colombia is strictly full gestational surrogacy, in which the surrogate provides no genetic material whatsoever—a practice that is expressly prohibited in the vast majority of countries offering these arrangements.

Under current legal procedures governing surrogacy laws in colombia, the genetic material is provided either directly by the intended parents or through a donor. When resorting to a donor, it can exclusively be an egg donor; because there is no automatic pre-birth court ruling, paternity is determined strictly by biological filiation, and the commissioning father must prove his direct biological relationship with the baby.

The donor can be anonymous or chosen. Donors are usually healthy women between 18 and 26 years of age, who are subject to strict medical control to guarantee their state of health.
