Destinations for surrogacy



GESTLIFE performs programmes in every country where surrogacy is legal and where the necessary guarantees are given. We are, therefore, not obliged to either offer you the only destination we have, as if it were outstanding, nor to denigrate other countries, for the simple reason that we do not have them included among our programmes.

Currently, surrogacy process with full guarantees, is available in the following countries:


GREECE

In Greece, surrogacy programmes are being carried out since 2004. In 2015, (the law was amended in July, 2014) the possibility of carrying out surrogacy processes was extended to foreign citizens.

In 2015, (the law was amended in July, 2014) the possibility of carrying out surrogacy processes for foreign citizens was extended.There is a great shortage of Greek surrogate mothers since they require amounts that are not in compliance with the law. As a result, it becomes necessary to employ surrogate mothers from Russia or Ukraine, who comply with the limits set by the law preventing, therefore, the perpetration of a crime.
We are within Schengen area, so when it comes to moving with the baby, we don't cross borders. The intended mother may not be more than 50 years old (at the moment of the trial).
It is a European country, close and similar to ours. The flight time is 2’ 41’’.The intended mother must prove with a medical certificate her impossibility to become pregnant, or that this means a serious risk to her health.
The children are registered in the Consulate of UK with the birth certificate and the judgement. (Other agencies will tell you that this is not true, given that Greece has become a tough competitor to agencies that promote the USA, but the Consulate of UK in Athens guarantees it).

UKRAINE


ADVANTAGESDISADVANTAGES
They offer fixed-fee programmes that include most of the possible eventualities. Therefore, in most cases, there are no extra expenses.No judgement is obtained but a birth certificate with The Hague Convention Apostille. The child will arrive registered under his father’s name, so that the intended mother must adopt the child once in the UK. (Procedure without complications.).
The cost of a process is much lower than in the USA. Most programmes range from 50,000 to 60,000 euros in total.Only heterosexual married couples.
GESTLIFE has its own offices and staff (13 people) in Kiev, focused on the control and monitoring of processes. The intended mother must prove with a medical certificate her impossibility to become pregnant, or that this means a serious risk to her health.
There is a greater closeness since the flight time is 3 and a half hours.

RUSSIA

It is a country that has been carrying out processes of surrogacy for foreign citizens for more than 20 years. They have first-level clinics as in Europe.

Married couples, common-law couples, single women. Single men are not expressly recognized in the law but they are neither prohibited from it.No judgement is obtained but a birth certificate with The Hague Convention Apostille. The child will arrive registered under his father’s name, so that the intended mother must adopt the child once in the UK. (Procedure without complications.).
Cost clearly lower than the ones in the USA.
Closer proximity (The flight time is 4 hours).

USA

It is one of the countries with more experience in the processes of surrogacy. However, due to its price, it is one of the destinations that our intended parents choose the least, given that there are other destinations that offer the same guarantees at a lower price.

A judgement on behalf of both intended parents is obtained. The judgement must be, subsequently, recognized in the UK.
Any kind of people may carry out processes, regardless of their marital status or sexual condition (married, common-law couples, single men, single women, homosexual couples.)There is no social security, therefore all incurred medical expenses are borne by you.
There is no fixed-fee. If there are extra expenses, such as incubator, etc. you will have to pay for them and the cost of the process can skyrocket.
There is a shortage of surrogate mothers, so the time of assignment of a surrogate mother can take 6-8 months..
The agency assigns a surrogate mother to you, but she must accept you as intended parents.
The cost of the processes is the most expensive in the world. A process costs between €90,000 and €180,000, if there are no surprises.

CANADA

CANADA is a destination that appears and disappears from the surrogacy forums. It is a country where surrogacy is NOT COMMERCIAL, that is, altruistic. The surrogate mother cannot receive compensation for the fact that she is carrying out the pregnancy on your behalf. It must be done via altruistic surrogacy. Any payment on this matter is punishable by imprisonment. Intermediation is also prohibited, so there are no classic agencies to use, and this makes it very difficult to monitor the process effectively.

This makes it very difficult to obtain surrogate mother.
Intermediation and advertising of any kind, including between private individuals, is prohibited with prison sentences..

There is no fixed-fee. If there are extra expenses, such as incubator, etc. you will have to pay for them and the cost of the process can skyrocket.
There is a shortage of surrogate mothers, so the time of assignment of a surrogate mother can take from 12 months to a year and a half.
The surrogate mother must accept you as intended parents
The cost of the processes is like USA. A process costs between €90,000 and €180,000, if there are no surprises.

PORTUGAL

On August 22, 2016, Law 25/2016 was published, establishing the conditions for implementing surrogacy, which was not permitted until then. Since August 1, 2017, surrogacy for foreign citizens is allowed in Portugal.


ADVANTAGESDISADVANTAGES
Foreign nationals, heterosexual married couples, unmarried couples or lesbian women may carry out processes in this country. Single men or same-sex couples are excluded.In the case of single women, the legislation of our country prevents single mothers from carrying out the process in those countries that do not issue a judgement and, therefore, no filiation takes place in the name of the intended mother (unlike the USA, and GREECE).
The law requires that the intended mother (the British mother) must prove with a medical certificate that she does not have a uterus, or that as a result of medical problems, her uterus will not be able to gestate a baby. The law does not mention other possible reasons..
Only altruistic surrogacy is allowed. The surrogate mother cannot receive any remuneration or financial compensation for carrying the pregnancy to term..
The performance and acceptance of the treatment will depend on the authorization of the “CNPMA (Conselho Nacional de Procriação Medicamente Assistida)” and of the previous opinion of “Ordem dos Médicos”.

GEORGIA

It is cheaper than in the USA. No judgement is obtained but a birth certificate with The Hague Convention Apostille. The child will arrive registered under his father’s name, so that the intended mother must adopt the child once in the UK. (Procedure without complications.).
Closer proximity: 4 hours flight. There is no UK Consulate or Embassy in Georgia, so you have to go to Turkey (Istanbul) to register your child in the consular register.
Prices are somewhat higher than those in Ukraine.
There are no closed programmes with an unlimited number of implantations as there are in Ukraine.
Only heterosexual married couples.
The intended mother must prove with a medical certificate her impossibility to become pregnant, or that this means a serious risk to her health.

KAZAKHSTAN

Cost clearly lower than the one in the USA. No judgement is obtained but a birth certificate with The Hague Convention Apostille. The child will arrive registered under his father’s name, so that the intended mother must adopt the child once in the UK. (Procedure without complications.).
Closer proximity: 5 hours flight. Only heterosexual married couples.
Prices are higher than those in Ukraine and Georgia.
There are no closed programmes with an unlimited number of implantations.
The intended mother must prove with a medical certificate her impossibility to become pregnant, or that this means a serious risk to her health.

COUNTRIES THAT REJECT SURROGACY.


Over the last few years, several countries have closed their doors regarding surrogacy, either to certain groups, or in a general way. At present, foreign citizens are forbidden from carrying out surrogacy in the following countries: Mexico*, Thailand, Nepal. If any agency offers you one of these destinations, reject it immediately because in these countries, foreign citizens cannot carry out surrogacy, under severe imprisonment sentence.

*In Mexico, foreign parents were forbidden from participating in the processes initiated since January 15th, 2016. The processes initiated before that date have remained ongoing.


OTHER EUROPEAN COUNTRIES.


The United Kingdom, Belgium, Chypre and Czech Republic, are countries where something about surrogacy is frequently heard. Some of them have a regulation only for resident citizens of the country, or they have no regulation at all. Thus, they are not governed by a surrogacy law, but by their own civil code and corresponding laws.
The United Kingdom: it is for British only.
Belgium: there is no legislation. Thus, it is clear that the child born there will be Belgian.
CHYPRE: it is currently forbidden
Czech Republic: some agencies carry out their fertility processes in this country, causing children to be born in other countries different from Czech Republic. In Czech Republic, there is no legislation that allows surrogacy. Thus, once again, we are moving in an area of legal loopholes, and in the shadows.


COUNTRIES WHICH HAVE BEEN HEARD ABOUT.


From time to time, new destinations where surrogacy can, apparently, be carried out appear in the surrogacy forums. These are pretty much third-world countries where there is no legislation at all about this subject. Neither for nor against, because medicine moves on faster than the law. As it happened in Thailand, or Nepal, where these countries became, for a short period of time, in an “oasis” for certain parents who did not meet the requirements stipulated in other countries. These countries ended up forbidding surrogacy for foreigners and applying significant imprisonment sentences in their respective criminal codes for foreigners who break the law. Nowadays, Cambodia or Vietnam have become fashionable. However, both countries lack legislation in that regard. In these countries, processes are developed, until the authorities discover it, and end up legislating against it. We must, therefore, strongly advise them not to listen to proposals of this kind, which would lead them to a land without the slightest legal guarantee, and with enormous legal risks for them.
